Terms of Sales

Article 1 General:

These general conditions of sale define the rights and obligations of each party when selling services within the framework of the sale of FiiLiT Parfum du voyage perfumes or services ancillary to the sale by the seller.

These general conditions of sale, as well as the prices, may be modified at any time without notice, except in the absence of specific clauses with the customer. Changes will have no impact on current orders.

The customer using the company Feel Diffusion (FiiLiT Parfum du voyage) acknowledges having read these general conditions of sale and accepts them without reservation.

Article 2 The Parties to the contract:

The term “client” describes any legal or natural person calling on Feel Diffusion for perfume sales services or any associated equipment.

The term “third party” refers to any natural or legal person who is not a party to the contract.

The term “provider” refers to Feel Diffusion

The T&Cs applicable then are those in force on the date of the order or payment (or the first payment in the event of multiple payments) of the order. These General Terms and Conditions can be consulted on the Company's website at the address https://fiilit.com/fr/conditions-generales-de-ventes du site fiilit.com.

The Client declares that he is able to legally contract under French laws or validly represent the natural or legal person for whom he is contracting.

Unless proven otherwise, the information recorded by the Company on the fiilit.com site constitutes proof of all transactions.

Article 3: Characteristics of the products and services offered

The products and services offered are those which appear in the catalog published on the site. These products and services are offered while stocks last. Each product is accompanied by a description established by the publisher based on the descriptions provided by the supplier. The photographs of the products in the catalog reflect a faithful image of the products and services offered but are not contractual to the extent that they cannot ensure perfect similarity with the physical products.

Article 4: Prices

In Europe, except for professionals who are already customers whose prices are indicated excluding VAT (VAT is applied to the basket) or unless otherwise stated, the prices appearing in the catalog are prices understood in Euros all taxes included (TTC), taking into account the VAT applicable on the day of the order. In North America the prices appearing in the catalog are prices in Canadian Dollar ($CAD) or US Dollar ($USD) excluding taxes, as is customary, state or local taxes are applied from the order cart depending on the billing address.

Feel Diffusion reserves the right to reflect any change in the VAT rate or state and local taxes on the price of the products or services. The publisher also reserves the right to modify its prices at any time. However, the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

Article 5: Compliance

In accordance with article L.411-1 of the Consumer Code, the products and services offered for sale through these General Terms and Conditions meet the requirements in force relating to the safety and health of people, the loyalty of commercial transactions and consumer protection. Regardless of any commercial guarantee, the Seller remains liable for any lack of conformity and hidden defects in the product.

In accordance with legal provisions regarding conformity and hidden defects (art. 1641 c.civ.), the Seller refunds or exchanges defective products or products that do not correspond to the order. Article 6: Reservation of ownership clause

The products remain the property of the Company until full payment of the price.

All elements published on the fiilit.com site belong to the publisher or a third party, or are used by the editor on the site with the authorization of their owner. Any copy of logos, textual, pictographic or video content, without this list being exhaustive, is strictly prohibited and amounts to counterfeiting. Any member who is guilty of counterfeiting would be likely to see his account deleted without notice or compensation and without this deletion constituting him any damage, without reservation of possible subsequent legal proceedings against him, at the initiative of the publisher of this site or its agent.

Article 6.1 Trademarks

The brands and logos contained on the site are registered by Feel Diffusion, or possibly by one of its partners, in particular to allow customers of the products distributed to identify the partner brands (unless otherwise advised by them). Any person carrying out their representations, reproductions, nestings, disseminations and rebroadcasts incurs the sanctions provided for in articles L.713-2 et seq. of the Intellectual Property Code.

The brands, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these General Terms and Conditions. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 7: Delivery terms and availability

The Seller reminds that at the moment when the Customer takes physical possession of the products, the risks of loss or damage to the products are transferred to him. It is up to the Customer to notify the carrier of any reservations about the delivered product.

If an item is unavailable for a period of more than 14 working days, you will be immediately informed of expected delivery times and the order for this item may be canceled upon simple request.

The Customer can then request a credit for the amount of the item or a full refund and cancellation of the order.

Delivery costs will be indicated to the customer before any payment and only concern deliveries made in France, the European Union, Switzerland and the United Kingdom, or on the North American continent, Canada and the United States. For any other delivery location, it will be up to the customer to contact customer service.

Unless otherwise stated on the site during the order process or in the description of the products ordered, the publisher undertakes to deliver the products within a maximum period of 15 days after receipt of the order.


The buyer may refuse a package at the time of delivery if he notices an anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.); any anomaly must then be indicated by the buyer on the delivery note, in the form of handwritten reservations, accompanied by the buyer's signature. To exercise his right of refusal, the buyer must open the damaged or defective package(s) in the presence of the carrier and have him take back the damaged goods. Failing to comply with these requirements, the buyer will not be able to exercise his right of refusal, and the company Feel Diffusion will not be required to comply with the buyer's request to exercise his right of refusal.

If the buyer's package is returned to the publisher by the Post Office or by other postal service providers, the publisher will contact the buyer upon receipt of the returned package to ask them what action to take on their order. If the buyer has mistakenly refused the package, he or she may request its return by first paying the postal costs for the new shipment. Postal costs must be paid even for orders for which shipping costs were free when ordering.

In the event of a delivery or exchange error (if the right of withdrawal is applicable, that is to say if the customer is not a professional and the contract concluded to acquire the good or service allows withdrawal, according to article L 121-21-8 of the Consumer Code), any product to be exchanged or refunded must be returned to the company Feel Diffusion in its entirety and in perfect condition. Any defect resulting from clumsiness or false maneuvering by the buyer cannot be attributed to the company Feel Diffusion.

In accordance with article L.121-21 and paragraphs of the Consumer Code, and if the right of withdrawal is applicable, the consumer has a period of 14 working days from the date of delivery of their order to return any item that does not suit them and request an exchange or refund without penalty, with the exception of return costs, within fourteen days from receipt by Feel Diffusion of the refund request. The product must be returned in perfect condition. If applicable, it must be accompanied by all its accessories. If the preceding obligations are not fulfilled, the buyer will lose his right of withdrawal and the product will be returned to him at his expense.

It is recommended that the buyer make the return using a solution that allows tracking of the package. Otherwise, if the returned package does not reach the company Feel Diffusion, it will not be possible to launch an investigation with the postal services in order to ask them to locate it.

Return costs in the event of withdrawal remain the responsibility of the buyer.

After receipt and acceptance of the complaint, the company Feel Diffusion will communicate by email or by telephone to the buyer the terms of exchange or reimbursement of the products. In order to properly process the request, the customer is asked to attach a copy of the invoice when making any complaint. Reimbursement will be made by check or transfer.


Any delivery delay of more than fourteen working days may result in the sale being canceled at the consumer's initiative, upon written request from the consumer by registered letter with acknowledgment of receipt. The consumer will then be reimbursed, within a maximum period of fourteen days, for the sums they incurred when placing their order. This clause is not intended to apply if the delivery delay is due to a case of force majeure. In such a case, the customer undertakes not to take legal action against the site and its publisher and waives the right to avail itself of the resolution of the sale provided for in this article.

Feel Difusion guarantees the Colissimo return service according to the following characteristics:

Article 8: Invoices and payments

Any order or service generates a digital invoice for the attention of the customer on their billing address.

Except for an additional payment deadline agreed by agreement between the two parties and appearing on the invoice, payment is made no later than the 30th day following the invoice date (C. Com. art. L. 441-6, al. 2 amended by the law of May 15, 2001). A late penalty of 10% on the total amount of the invoice may be applied (law 2008-776 of August 4, 2008), minimum recovery compensation of €40 (decree 2012-1115 of October 2, 2012) or return of products books. Payments by bank transfer or check payable to Feel Diffusion without discount in the event of early payment.

On the fiilit.com website, payment is due immediately upon ordering, including for pre-ordered products. The Internet user can place an order on this site and can pay by credit card or Paypal.

Payments by credit card are made using secure transactions provided by an online payment platform provider (Stripe).

This site does not have access to any data relating to the user's means of payment. Payment is made directly into the hands of the bank or payment provider receiving payment from the Customer. In the event of payment by check or bank transfer, the delivery times defined in the article below only begin to run from the date of effective receipt of payment by the seller, the latter being able to provide proof of this by all means. Product availability is indicated on the site, in the description sheet of each item.

Article 9: Guarantees

In accordance with the law, the Seller assumes the following guarantees: conformity and relating to hidden defects in the products. The Seller reimburses the buyer or exchanges products that are apparently defective or do not correspond to the order placed.

Warranty for purchased products:

All items acquired on this site benefit from the following legal guarantees, provided for by the Civil Code;

Article 9.1 Guarantee of conformity

According to articles L. 211-1 to L. 212-1 of the Consumer Code, the seller is required to deliver goods that comply with the contract and to respond to any lack of conformity existing during delivery of the goods. The guarantee of conformity may be exercised if a defect should exist on the day of taking possession of the product. However, when the defect appears within 24 months following this date, it is presumed to meet this condition. On the other hand, after this period of 24 months, it will be up to the customer to prove that the defect existed at the time of taking possession of the property.

In accordance with article L. 211-9: "in the event of a lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if this choice results in a cost that is clearly disproportionate with regard to the other method, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer."

Article 9.2 Guarantee against hidden defects

According to articles 1641 to 1649 of the Civil Code, the customer may request the exercise of the guarantee of hidden defects if the defects presented did not appear at the time of purchase, were prior to the purchase (and therefore not result from normal wear and tear of the product for example), and be sufficiently serious (the defect must either make the product unfit for the use for which it is intended, or reduce this use to such an extent that the buyer would not have purchased the product or would not have purchased it at such a price if he had known of the defect).

Section 9.3

The products supplied by the seller benefit, in addition to the legal guarantee which is, where applicable, always applicable to them, from a guarantee specific to the site and provided by Feel Diffusion, under the following conditions:

"- The package is returned without having been opened, we will reimburse you the price of the package and any shipping costs in Metropolitan France

- The product is returned at your discretion, we will reimburse you the price of the product, the return costs remaining at your expense.

- The product is returned due to our responsibility, we will reimburse you for the product, shipping and possible return costs in Metropolitan France.

- Products whose packaging has been opened and/or used cannot be returned."

Complaints, requests for exchange or reimbursement for a non-compliant product must be made by post or by email to the addresses indicated in the legal notices of the site, within thirty days from the date of delivery (this deadline does not apply in the event of a hidden defect, as stipulated previously).

In the event of non-compliance of a delivered product, it may be returned to the seller who will exchange it. If it is impossible to exchange the product (obsolete product, out of stock, etc.) the buyer will be reimbursed by check or transfer for the amount of their order.

Article 10 Protection of site data and personal data

Article 10.1 Archiving

Feel Diffusion will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 10.2 Complaints

Any complaint related to the use of the website, the service offered on this site, or any other related service, the pages of the site on possible social networks or the general conditions, legal notices or personal data charter must be filed in 365 days following the day of origin of the problem giving rise to the complaint, regardless of any law or rule of law to the contrary. In the event that such a claim has not been filed within the following 365 days, such claim will be forever inapplicable in court.

Article 10.3 Inaccuracies

It may be possible that there are, throughout the website and the services offered, and to a limited extent, inaccuracies or errors, or information that is inconsistent with the general conditions, legal notices or charter. of personal data. In addition, it is possible that unauthorized modifications may be made by third parties on the site or on ancillary services (social networks, etc.). Article 11: Force majeure

The execution of the seller's obligations hereunder is suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent execution. The seller will notify the customer of the occurrence of such an event as soon as possible.

Article 12: Nullity and modification of the contract

If one of the stipulations of this contract were canceled, this nullity would not result in the nullity of the other stipulations which will remain in force between the parties. Any contractual modification is only valid after written and signed agreement of the parties.

Article 13: Protection of personal data

In accordance with Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of this data, the Seller sets up a processing of personal data which has the purpose the sale and delivery of products and services defined in this contract.

Article 14: Applicable law and clauses

All clauses appearing in these general conditions of sale, as well as all purchase and sale operations referred to therein, will be subject to French law. The nullity of a contractual clause does not entail the nullity of these general conditions of sale.

Article 15: Consumer information

For consumer information purposes, the provisions of the Civil Code and the Consumer Code are reproduced below:

Article 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have it acquired, or would have given only a lower price, if he had known them.

Article 1648 of the Civil Code: Action resulting from fatal defects must be brought by the purchaser within two years from the discovery of the defect.

In the case provided for by article 1642-1, the action must be brought, under penalty of foreclosure, within the year following the date on which the seller can be released from apparent defects or lack of conformity.

Article L. 217-4 of the Consumer Code: The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

Article L. 217-5 of the Consumer Code: The good complies with the contract:

1° If it is suitable for the use usually expected of similar goods and, where applicable:

- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

- if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L. 217-12 of the Consumer Code: Action resulting from lack of conformity is prescribed two years from delivery of the goods.

Article L. 217-16 of the Consumer Code: When the buyer requests from the seller, during the course of the commercial guarantee which was granted to him during the acquisition or repair of movable property, a restitution condition covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run.

This period runs from the buyer's request for intervention or the making available for repair of the goods in question, if this making available is subsequent to the request for intervention.

Withdrawal form
In accordance with article L121-17 of the Consumer Code, ("Hamon law") of June 2014, the Customer can find below a standard withdrawal form for an order placed on the site, to be sent to Feel Diffusion in with acknowledgment of receipt. It is understood that the customer will bear the costs of returning the good in the event of withdrawal, as well as the cost of returning the good if it, due to its nature, cannot normally be returned by post, and that this This withdrawal can only be carried out under the withdrawal conditions stipulated in these general conditions of sale.
