GENERAL TERMS AND CONDITIONS OF SALE AND USE (GTC-GCU) FiiLiT.com (Individual Customers - B2C)

Preamble
These General Terms and Conditions of Sale and Use (hereinafter "GTC/GCU") govern the contractual relationship between Feel Diffusion SAS, operating under the trademark FiiLiT (hereinafter "FiiLiT", "We", "Us", "Our"), and any adult natural person acting as a consumer within the meaning of the French Consumer Code (hereinafter "the Customer", "You", "Your", "the Buyer", "the User") browsing the website www.fiilit.com (hereinafter "the Site") and/or making a remote purchase there.
These T&Cs/T&Cs aim to define the terms and conditions of sale of FiiLiT products to Customers, as well as the rights and obligations of the parties arising from the online sale. They also define the conditions of access and use of the Site.
These Terms and Conditions do not apply to purchases made by professionals (resellers, businesses), which are governed by specific B2B General Terms and Conditions of Sale or distribution contracts, nor to Affiliate partners, whose relationships are governed by the Terms and Conditions of the Affiliate Program.
Access to and use of the Site, as well as placing an order, imply your full and unreserved acceptance of these Terms and Conditions, which you acknowledge having previously read. These Terms and Conditions are accessible at any time on the Site. You declare that you have full legal capacity to enter into these Terms and Conditions.
FiiLiT reserves the right to modify these Terms and Conditions at any time. The applicable conditions are those in effect on the Site on the date you log in or place your order. The date of the last update is indicated at the top of this document.

Article 2: Access and Use of the Site
2.1 Access: The Site is accessible free of charge to any User with Internet access. All costs related to accessing the Site (hardware, software, Internet access, etc.) are the sole responsibility of the User.
2.2 Customer Account: Creating an account may be necessary to access certain features, particularly to place an order. When creating an account, the Customer agrees to provide accurate, complete, and up-to-date information. The User is solely responsible for maintaining the confidentiality of their login details (email address and password) and for any actions that may be taken under their account. They agree to immediately inform FiiLiT of any unauthorized use of their account. Account creation is reserved for individuals of legal age and capacity.
2.3 User Obligations: The User agrees to use the Site in accordance with these Terms and Conditions, the law, and accepted standards of morality. In particular, the User is prohibited from:
* Using the Site for illegal, fraudulent, or harmful purposes. * Disrupting or attempting to disrupt the proper functioning of the Site. * Posting or transmitting via the Site any illegal, threatening, defamatory, obscene, hateful, or otherwise objectionable content. * Violating the intellectual property rights of FiiLiT or third parties. * Collecting information about other users without their consent. 2.4 Account Suspension/Closure :FiiLiT reserves the right to suspend or close a User's account and to refuse them access to all or part of the Site, without notice or compensation, in the event of a violation of these Terms and Conditions, fraud, attempted fraud, or for any other legitimate reason. Article 3: Products The products governed by these Terms and Conditions are those listed on the Site on the day the Customer views it and which are indicated as sold and shipped by FiiLiT (hereinafter "the Products"). They are offered while stocks last. The essential characteristics of the Products (composition, capacity, origin, usage instructions, and any certifications such as Cosmos Natural/Organic or Slow Cosmétique) are presented on the dedicated product sheets on the Site, in accordance with Article L. 111-1 of the French Consumer Code. The photographs, graphics, and descriptions of the Products are as accurate as possible, but are for informational purposes only and are not contractually binding. Minor variations (particularly in color or packaging) may exist. FiiLiT shall not be liable in the event of a manifest error between the Product's characteristics and its representation. Article 4: Price Product prices are indicated in Euros (€) and/or the local currency specific to each country, inclusive of all taxes (TTC), including the French Value Added Tax (VAT) applicable on the date of the order. Any change in the statutory VAT rate will be automatically reflected in the price of the Products presented on the Site, on the date stipulated by the implementing decree. The prices indicated on the product sheets do not include delivery costs or potential customs duties. The total amount owed by the Customer, including the price of the Products and delivery costs (calculated according to the terms of Article 7), is indicated on the order summary page, before final confirmation of the order. FiiLiT reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the Site on the day of the order will be the only one applicable to the Customer, subject to availability of the Products at this price. Any promotional offers are valid for the validity period they mention and on the Products concerned. In the event that an incorrect, obviously ridiculous (low price) price is displayed, for whatever reason (computer bug, manual error, technical error), the order - even if validated by FiiLiT - will be canceled, of which we will inform You as soon as possible. You will then be able, if you wish, to re-order at the corrected and exact price. Customs duties are the responsibility of the customer, generally collected by the carrier. Article 5: Order 5.1 Capacity to Contract: The purchase of Products on the Site is reserved for natural persons of legal age (18 years or older) with full legal capacity. 5.2 Order Process: To place an order, the Customer must follow the steps described on the Site, including in particular: * Selecting Products and adding them to the cart. * Identification (login or account creation, or guest mode if available) and provision of delivery and billing information. * Selection of delivery method. * Selection of payment method (see Article 6). * Verification of the order summary. * Express acceptance of these Terms and Conditions by checking the appropriate box. * Final confirmation of the order by clicking on the payment button ("double click"). 5.3 Order Confirmation: After order validation and payment acceptance, FiiLiT will send the Customer an order confirmation email summarizing the essential information (order number, products, prices, delivery costs, addresses, etc.). This email constitutes FiiLiT's acknowledgment of receipt and acceptance of the order, subject to availability and payment validation. 5.4 Proof of Transaction: The computerized records of FiiLiT and its partners are considered proof of communications, orders, and payments. Archiving is carried out on reliable and durable media. 5.5 Order Refusal: FiiLiT reserves the right to refuse or cancel any order for legitimate reasons (previous dispute, suspected fraud, incorrect address, abnormal quantity, etc.) or to request supporting documents. 5.6 Product Unavailability: In the event of unavailability of a Product after ordering, FiiLiT will inform the Customer by email and offer a refund, replacement (with agreement), or waiting (if possible). If no response is received within a reasonable timeframe, the order may be partially or fully canceled with a refund. Article 6: Payment 6.1 Due Date: Payment of the full price is due immediately upon ordering. 6.2 Payment Methods: Payment is made in Euros (€) using one of the following secure methods: * Credit card: Carte Bleue, Visa, Mastercard, American Express (Amex). SSL secure transaction via our payment service provider. Debit upon order confirmation. * PayPal: Via the Customer's PayPal account. * Klarna: Payment options offered by Klarna (e.g., Pay Now, Pay Later), subject to Klarna's terms and conditions. * Alma: Installment payment option (e.g., 4 installments) offered by Alma, subject to Alma's terms and conditions. 6.3 Payment Security: Transactions are secured by SSL protocol. FiiLiT does not have access to the Customer's complete banking information. 6.4 Verification and Anti-Fraud: Verifications (request for supporting documents) may be carried out to prevent fraud. Failure to respond may result in the order being cancelled. 6.5 Payment Incident: FiiLiT may suspend or cancel an order in the event of payment refusal or non-payment. 6.6 Retention of Title Clause: The Products remain the property of FiiLiT until full payment has been made. The transfer of risks occurs upon receipt by the Customer. Article 7: Delivery 7.1Delivery areas: FiiLiT delivers to Metropolitan France (including Corsica and Monaco), the European Union, and certain international countries. The list and conditions are detailed in our Shipping Policy, accessible here: https://fiilit.com/policies/shipping-policy. It is the Customer's responsibility to check any taxes or customs duties applicable upon entry into the destination country, which remain their responsibility. 7.2 Delivery Methods and Times: * Available delivery methods (Colissimo, Chronopost, Mondial Relay, etc.) and their costs are provided at the time of ordering. * Indicative delivery times (in business days, after dispatch) are specified at the time of ordering and in our Shipping Policy. * FiiLiT generally ships within a standard delivery time, e.g., 1 to 3 business days. The Customer will receive a shipping email with tracking. * In the event of a significant delay not due to force majeure, the Customer may terminate the contract in accordance with the terms of Article L. 216-2 of the French Consumer Code (after formal notice has remained unsuccessful). 7.3Delivery costs: Indicated before order confirmation, calculated according to method, weight/volume, and destination. The conditions for free delivery are specified on the Website and in the Shipping Policy. 7.4 Receipt and Verification: * The Customer must check the condition of the package and Products upon receipt in the presence of the delivery person. * In the event of an anomaly (damaged or opened package, missing/damaged products): 1. Make specific reservations on the carrier's delivery slip. 2. Refuse the package if necessary. 3. Confirm your reservations to the carrier (recommended delivery by registered letter with acknowledgement of receipt within 3 business days). 4. Immediately inform FiiLiT Customer Service (parfumduvoyage@fiilit.com) with details and photos. * Without reservations, the delivery is deemed compliant (subject to legal guarantees). 7.5 Incorrect/Incomplete Address: Reshipping or return costs in the event of cancellation due to an incorrect address are the responsibility of the Customer. Article 8: Right of Withdrawal 8.1 Time Limit and Scope: The Customer has 14 calendar days from the receipt of the last Product of their order to exercise their right of withdrawal, without reason, in accordance with Articles L. 221-18 et seq. of the French Consumer Code. 8.2 Exclusions: The right of withdrawal is excluded for cosmetic Products (perfumes)that have been unsealed (cellophane, seal, blister removed or opened) after delivery, for reasons of hygiene and health protection (Article L. 221-28, 5°). 8.3 Exercise: Notification to FiiLiT (parfumduvoyage@fiilit.com or postal mail - see Art. 1) before the expiry of the deadline, via the standard form (end of Terms and Conditions of Sale/Terms of Use) or any clear statement. 8.4 Return of Products: Return by the Customer within 14 days of notification of withdrawal, to the following address: FEEL DIFFUSION (FiiLiT Parfum du Voyage), 8 rue de Paris, 91570 Bièvres, France 8.5 Return Conditions: * Products intact, unopened, unsealed, unused, in their complete original packaging, suitable for resale. * Attach a copy of the invoice/delivery slip or order number. 8.6 Return costs: At the Customer's expense. Tracked shipping recommended. 8.7 Refund: * If conditions are met: full refund of the amounts paid for the returned Products, including initial delivery costs (standard basis). * Deadline: max. 14 days after notification of withdrawal, subject to receipt of the returned Products or proof of shipment provided by the Customer. * Method: same payment method as the initial purchase (unless otherwise agreed). * For more details, see our Refund Policy:https://fiilit.com/policies/refund-policy Article 9: Abusive Returns and Brand Protection 9.1 Characterization of Abusive Returns: FiiLiT reserves the right to refuse to process future orders and/or to restrict access to the Site to Customers engaging in return practices deemed abusive or fraudulent. The following are considered abusive:
* Repeated returns of opened, unsealed, or used products, in flagrant violation of the conditions set out in Article 7.5. * Systematic returns or returns of abnormally high frequency suggesting use of the products beyond simply verifying their conformity or a circumvention of the right of withdrawal. * Returns made well outside the legal or contractual deadlines without valid justification. * Repeated declarations of non-receipt despite formal proof of delivery from the carrier. * Any behavior clearly aimed at circumventing established return rules or fraud. 9.2 Procedure in case of suspected abusive returns: * In case of suspected abusive practices, FiiLiT may contact the Customer for clarification. * If the abusive nature is confirmed, FiiLiT will inform the Customer in writing (email or letter) of the reasons for the return refusal or the proposed restrictions (e.g., refusal of future orders, requirement for a specific delivery method with signature, reporting, etc.). * FiiLiT reserves the right to take any appropriate legal action to protect its business interests and prevent fraud. 9.3 Protection against returns of inauthentic or modified products : FiiLiT will not accept under any circumstances the return of products that are not those initially shipped (batch verification, code, etc.), that have been altered, modified, or that show obvious signs of counterfeiting. If such products are returned, no refund will be issued, and FiiLiT reserves the right to retain fraudulent products as evidence and to initiate civil or criminal legal proceedings. Article 10: Legal Guarantees All Products sold on the Site benefit from the legal guarantees in force, namely: 10.1 Legal Guarantee of Conformity (Articles L. 217-4 to L. 217-14 of the French Consumer Code): * FiiLiT is required to deliver a Product that complies with the contract and is liable for any lack of conformity existing at the time of delivery. * Lack of conformity is presumed exist at the time of delivery if it appears within two (2) years of delivery. * In the event of a lack of conformity, the Customer may choose between repair or replacement of the Product. However, FiiLiT may not proceed according to the Customer's choice if this choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the Product or the extent of the defect. It is then required to proceed, unless impossible, according to the option not chosen by the Customer. * If repair and replacement of the Product are impossible, the Customer may return the Product and receive a refund, or keep the Product and receive a partial refund. The same option is available to the Customer if the requested solution (repair or replacement) cannot be implemented within one month of the Customer's complaint, or if this solution cannot be implemented without significant inconvenience to the Customer, given the nature of the goods and the intended use. * However, the sale cannot be cancelled if the lack of conformity is minor. * The application of the legal guarantee of conformity takes place at no cost to the Customer. 10.2 Legal guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code): * FiiLiT is bound by the guarantee for hidden defects in the item sold that render it unfit for the use for which it is sold. intended, or which so diminish this use that the Customer would not have purchased it, or would have paid a lower price for it, had they been aware of them. * The defect must predate the sale and render the Product unfit for its use. * The action resulting from latent defects must be brought by the Customer within two (2) years of discovering the defect. * In this case, the Customer may choose either to return the item and receive a refund (redhibitory action), or to keep the item and receive a partial refund (estimate action). 10.3Implementation of guarantees : For any request under legal guarantees, the Customer must contact FiiLiT Customer Service by email at parfumduvoyage@fiilit.com, indicating their order number, the Product concerned and describing the defect observed in detail (photos may be requested). FiiLiT will inform the Customer of the procedure to follow. The return costs of non-compliant or defective Products will be covered by FiiLiT (upon presentation of supporting documents or via a prepaid return label). Article 11: Liability 11.1 Limits of Liability (Sale): FiiLiT shall not be liable for: * Non-compliance with the legislation of the country of delivery (to be verified by the Customer). * Misuse, professional use (B2C products), negligence, lack of maintenance. * Normal wear and tear. * Force majeure (Article 16). * Indirect damages. Liability is limited to the amount of the order in question. 11.2 Limits of Liability (Use of the Site): * FiiLiT strives to ensure the availability of the Site but cannot guarantee it at all times (possible interruptions for maintenance, technical reasons, etc.). * FiiLiT cannot be held liable for damages related to the use of the Internet (intrusions, viruses, service interruptions, etc.). * The Site may contain links to third-party sites; FiiLiT is not responsible for the content or practices of these sites. * FiiLiT does not guarantee that the Site will be error-free or bug-free. Article 12: Intellectual Property All elements of the Sitewww.fiilit.com, whether visual (brands, logos, photographs, graphics, videos, etc.) or audio, as well as the texts, comments, works, illustrations, the structure of the site, and the underlying technology (software, databases), are the exclusive property of Feel Diffusion SAS. (FiiLiT) or its partners and are protected by French and international intellectual property laws (copyright, trademark law, database law). The "FiiLiT" trademark, as well as all figurative and non-figurative trademarks and, more generally, all other trademarks, illustrations, images, and logos appearing on the Products, their accessories, and their packaging, whether registered or not, are and will remain the exclusive property of FiiLiT. Any total or partial reproduction, modification, adaptation, translation, or use of these elements, in any form whatsoever and on any medium whatsoever, without the express, prior written consent of FiiLiT, is strictly prohibited and constitutes counterfeiting, punishable under Articles L. 335-2 et seq. of the French Intellectual Property Code. intellectual property. FiiLiT's failure to initiate proceedings upon becoming aware of such unauthorized uses does not constitute acceptance of such uses or a waiver of legal action. The creation of simple hyperlinks directly to the Site's homepage or any other page on the Site is subject to FiiLiT's prior written consent. Under no circumstances may these links be created in a context that could be detrimental to FiiLiT (disparagement, unfair competition, etc.). FiiLiT reserves the right to request the removal of any unauthorized link. Deep links or links using "framing" or "in-line linking" are strictly prohibited. Article 13: Personal Data FiiLiT collects and processes the personal data of Customers/Users in accordance with the GDPR and the French Data Protection Act. Purposes: Order management, delivery, payment, customer relations (after-sales service), sending offers (with consent), combating fraud, improving the site, statistics. Data collected: Identity, contact details, purchase history, login details, etc. Recipients : FiiLiT services, subcontractors (payment, transport, accommodation, etc.). Retention period: Duration necessary for the purposes + legal deadlines. Customer/User Rights: Access, rectification, deletion, opposition, limitation, portability, withdrawal of consent, post-mortem directives. Article 14: Conditions Applicable to Resellers (Reminder) These Terms and Conditions do not apply to Authorized Professional Resellers. Their relationship with FiiLiT is governed by a specific distribution agreement and/or separate B2B Terms and Conditions. Article 15: Conditions Applicable to Affiliates (Reminder) These Terms and Conditions do not apply to Affiliate partners. Their relationship with FiiLiT is governed by the FiiLiT Affiliate Program Specific Terms and Conditions [https://fiilit.com/pages/affiliate] which specify, in particular, promotional obligations, rules for using links, commissions, and the need to comply with the policies of the third-party platforms used (e.g., TikTok) as well as the regulations applicable in the authorized territories (e.g., UK, ES, FR, IE, IT for TikTok Affiliates, subject to confirmation in the Affiliate Terms). FiiLiT are purchased by the Customer via a third-party platform (marketplace, social network such as TikTok Shop, etc.), the general terms and conditions of sale and payment of this platform may also apply, in particular with regard to the ordering process, payment collection and the management of certain stages of delivery or customer service. The Customer is invited to consult the conditions of the platform concerned. These Terms and Conditions apply to the Product itself (quality, legal warranties) and aspects managed directly by FiiLiT. Article 17: Force Majeure Neither party shall be held liable to the other for non-performance or delays in the performance of an obligation under these Terms and Conditions, which are due to the occurrence of a case of force majeure within the meaning of Article 1218 of the French Civil Code and French case law. The following are considered cases of force majeure, but not limited to: natural disasters (floods, fires, storms), wars, riots, attacks, total or partial strikes (including postal services, means of transport or communication), lockouts, epidemics/pandemics recognized by the authorities, disruptions in energy or raw material supplies, major IT or telecommunications failures blocking activity. The party noting the event must immediately inform the other party of its inability to perform its service and provide justification to the latter. The suspension of obligations may under no circumstances be a cause of liability for non-performance of the obligation in question, nor may it result in the payment of damages or late payment penalties. As soon as the cause of the suspension of their mutual obligations has disappeared, the parties will make every effort to resume normal performance of their contractual obligations as quickly as possible. If the impediment is permanent or continues beyond thirty (30) days, this Agreement may be terminated automatically by either party, by written notice, without the right to compensation. If the termination concerns an ongoing order, FiiLiT will refund the amount in accordance with the terms of Article 7.7. Article 18: Partial Invalidity / Severability If one or more provisions of these General Terms and Conditions are held to be invalid, declared as such pursuant to a law, regulation, or following a final decision of a competent court, or if they become inapplicable for any reason whatsoever, the other provisions shall retain their full force and effect. The parties will then endeavor to replace the invalid provision with a valid provision that corresponds as closely as possible to the spirit and purpose of the initial provision. Article 19: Non-waiver The fact that one of the parties does not invoke at a given time any of the clauses of these General Terms and Conditions, or tolerates a breach by the other party of one of the obligations referred to, cannot be interpreted as a waiver by that party to subsequently invoke any of the said clauses or obligations. Article 20: Entire Agreement These General Terms and Conditions, the order summary sent to the Customer and the order confirmation email form a contractual whole and constitute the entirety of the contractual relations between the Parties concerning the subject matter hereof. They replace and cancel any prior agreement, verbal or written, having the same subject matter. Article 21: Applicable Law and Dispute Resolution 21.1Applicable Law: These General Terms and Conditions of Sale and the purchase and sale transactions resulting therefrom are governed by and interpreted in accordance with French law. The language of this contract is French. If these T&Cs are translated into another language, only the French version will be binding in the event of a dispute. 21.2 Prior Complaint: In the event of a dispute or complaint, the Customer should first contact FiiLiT Customer Service to seek an amicable solution: * By email: parfumduvoyage@fiilit.com * By post: FiiLiT Customer Service, Feel Diffusion SAS, 8 Rue de Paris, 91570 Bièvres, France. 21.3 Consumer Mediation: In accordance with the provisions of Articles L. 611-1 to L. 616-3 of the French Consumer Code, the Customer is informed that they may resort to free to a consumer mediator with a view to amicably resolving the dispute between them and FiiLiT, after first attempting to resolve their dispute directly with FiiLiT by submitting a written complaint in accordance with the terms set out in 19.2. This platform allows EU consumers and professionals to attempt to amicably resolve disputes arising from online purchases. 21.5Competent Courts: In the absence of an amicable resolution by direct complaint or mediation, any dispute relating to the existence, interpretation, execution, or termination of the contract concluded between FiiLiT and the Customer will be subject to the exclusive jurisdiction of the competent French courts, in accordance with the rules of the Code of Civil Procedure. The Customer may, at their choice, in addition to one of the courts with territorial jurisdiction under the Code of Civil Procedure, also refer the matter to the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
